Official Rules

 

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THIS SWEEPSTAKES. MAKING A PURCHASE DOES NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED. THIS SWEEPSTAKES IS ONLY OPEN TO LEGAL RESIDENTS OF THE 50 UNITED STATES AND DISTRICT OF COLUMBIA AND CANADA (EXCLUDING QUEBEC) 18 YEARS OF AGE AND OLDER AS OF OCTOBER 1, 2009, WHO ARE EMPLOYED AS FARMERS. DO NOT ENTER IF YOU ARE NOT LOCATED IN THE U.S. (INCLUDING D.C.) OR CANADA (EXCLUDING QUEBEC) AT THE TIME OF ENTRY.

1. Entry. The Sweepstakes begins on October 1, 2009 and ends on December 31, 2009 (the "Sweepstakes Period"). To enter, schedule a maintenance inspection performed on any agriculture equipment performed by an authorized Case IH dealer during the Sweepstakes Period ("Qualifying Inspection") and you will receive one (1) automatic entry into the Sweepstakes. Inspection of hand tools does not qualify. As an alternative to purchasing a Qualifying Inspection, you may submit entries via mail by sending a 3 x 5 index card containing your name, address, and telephone number, email address and date of birth to: Case IH Maintenance Event Sweepstakes Non-Purchase Alternative Entry , Dept. ZZ PO Box 5700 Clinton, IA 52736-5700. Mailed entries must be postmarked no later than December 31, 2009 and must be received no later than January 6, 2010. Limit of one (1) mail entry per person for all methods of entry combined. Sponsor and Administrator are not responsible for: i) lost, late, incomplete, illegible, damaged, garbled, destroyed, or misdirected entries or e-mail, or entries not received by Sponsor or Administrator for any reason; ii) any problems or technical malfunctions, errors, omissions, interruptions, deletions, defects, delays in operation or transmission, communication failures or human error that may occur in the transmission, receipt or processing of entries, or for destruction of or unauthorized access to, or alteration of, entries; or iii) failed or unavailable hardware, network, software or telephone transmissions, damage to entrants' or any person's computer and/or its contents, or causes beyond Sponsor's or Administrator's reasonable control that jeopardize the administration, security, fairness, integrity or proper conduct of this Sweepstakes; or iv) any entries submitted in a manner that is not expressly allowed under these rules; all such entries will be disqualified. All incomplete or otherwise non-conforming entries will be disqualified. 2. Eligibility. In order to be eligible to participate, each entrant must be employed as a farmer as a primary occupation, as of October 1, 2009, through December 31, 2009. Proof of eligibility will be required. Determination of whether entrant meets the eligibility requirements is at sole discretion of Sponsor. This Sweepstakes is not open to the general public. All entrants must be 18 years of age or older as of October 1, 2009, and upon request by Sponsor's personnel, must provide valid identification showing proof of age prior to completing. NO EXCEPTIONS. Entrants must be legal resident of one of the 50 United States/D.C. or Canada (excluding Quebec). The following are NOT eligible to enter this Sweepstakes: members of the general public who are not primarily employed as farmers; employees of Sponsor, its subsidiaries, affiliates and authorized Dealers; and any of the aforementioned entities' immediate families (spouse and parents, siblings and children, and each of their spouses, regardless of where they live) and persons living in the households of each of these individuals, whether related or not. This Sweepstakes is subject to all applicable federal, state, provincial and local laws and regulations.

 

3. Winner Selection. The potential Sweepstakes winner will be selected by a random drawing on or around January 7, 2010, by the Administrator, an independent judging organization whose decisions are final on all matters relating to this Sweepstakes. Odds of winning the Grand Prize depend upon the total number of eligible entries received by the date of the drawing. If the potential winner is a resident of Canada, the potential winner will be contacted by telephone and must correctly answer a timed mathematical skill question in order to be declared the winner.

 

5. Prize and Approximate Retail Value ("ARV"). One (1) Two-passenger, 14 horsepower, gasoline-powered, mid-size Case IH Scout? Utility Vehicle. ARV: $10,085 USD/ $10,935 CAD. ARV is as of date of printing of these Official Rules. The difference in value of prize as stated herein and value at time of prize notification, if any, will not be awarded. Prize is non-transferable and no cash equivalent or substitution of Prize is offered, except at the sole discretion of the Sponsor. If a prize, or any portion thereof, cannot be awarded for any reason, Sponsor reserves the right to substitute prize with another prize of equal or greater value. All fees and costs related to prize acceptance and/or use are the winner's exclusive responsibility. If winner is a U.S. resident, winner will be responsible for all federal, state, and/or local taxes on the prize. WINNER MUST ACCEPT DELIVERY AT A DEALERSHIP DESIGNATED BY SPONSOR WITHIN 30 DAYS OR PRIZE WILL BE FORFEITED.

 

6. Winner Notification. The potential winning eligible entry will be contacted by telephone, mail and/or e-mail within approximately seven (7) days after the drawing. Winners are subject to verification, including verification of age. If prize notification letter or any prize is returned as undeliverable, the corresponding prize will be awarded to an alternate winner. Sponsor is not responsible for any change of mailing address and/or telephone number of entrants. Minors - prizes won by an eligible entrant who is a minor in his/her state/province of residence, will be awarded to minor's parent or legal guardian who must sign and return all required documents. The potential winner may be required to sign and return a notarized Affidavit (or Declaration) of Eligibility, Liability Release, and a Publicity Release, within seven (7) days of initial notification. Failure to comply will result in forfeiture of prize and selection of an alternate winner.

 

7. General Terms.

By participating, entrants agree to these Official Rules, which are final and binding in all respects and that all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, participant's rights and obligations, or the rights and obligations of the Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of State of Wisconsin without giving effect to any choice of law or conflict of law rules. By entering, entrants consent to the jurisdiction and venue of the federal, state and local courts located in Racine County, Wisconsin. If for any reason this Sweepstakes cannot be executed as planned, for reasons including but not limited to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsor or Administrator that corrupt or affect the security, administration, fairness, integrity, or proper conduct of this Sweepstakes, or if this Sweepstakes is compromised or becomes technically corrupt in any way, electronically or otherwise, Sponsor reserves the right to terminate the Sweepstakes in its sole discretion. Sponsor reserves the right, at its sole discretion, to disqualify and prosecute any individual who tampers with or attempts to tamper with the entry process. If the Sweepstakes is terminated before the scheduled end date, Administrator will select the winner by random drawing from among all eligible, non-suspect entries. CAUTION: ANY ATTEMPT BY ANY PERSON TO DELIBERATELY CORRUPT THE SWEEPSTAKES OR TO UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO DISQUALIFY, PROSECUTE AND SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.

8. Limitation of Liability.

As a condition of entering, entrants (or their parent or legal guardian if an eligible minor) agree (and agree to confirm in writing): (a) to release Sponsor, its affiliates, subsidiaries, retailers, sales representatives, distributors and Administrator, and each of their officers, directors, employees and agents ("Promotional Parties"), from any and all liability, loss or damage incurred with respect to the awarding, receipt, possession, and/or use or misuse of any prize, including any traveling related thereto (b) under no circumstances will entrant be permitted to obtain awards for, and participant hereby waives all rights to claim, punitive, incidental, consequential, or any other damages, other than for actual out-of-pocket expenses; (c) all causes of action arising out of or connected with this sweepstakes, or any prize awarded, shall be resolved individually, without resort to any form of class action; and (d) any and all claims, judgments, and award shall be limited to actual out-of-pocket costs incurred, excluding attorneys' fees and court costs. Except where prohibited by law, Winner grants (and agrees to confirm this grant in writing, if requested) permission for Sponsor and those acting under its authority to use his/her name, photograph, voice and/or likeness, for advertising and/or publicity purposes in any and all media now known or hereinafter invented without territorial or time limitations and without compensation. BY ACCEPTING PRIZE, WINNER ACCEPTS THE INHERENTLY DANGEROUS NATURE AND RISK IN USING MOTORIZED VEHICLES, INCLUDING PERSONAL INJURY AND/OR DEATH, ACKNOWLEDGES THAT HIS/HER USE OF THE PRIZE IS VOLUNTARY, ACKNOWLEDGES THAT THERE ARE NATURAL FACTORS AND OCCURRENCES WHICH MAY IMPACT ON OR AFFECT THE SAFETY OF THE ACTIVITIES HE/SHE IS PARTICIPATING IN AND HE/SHE ASSUMES THE RISK OF SUCH FACTORS AND OCCURRENCES AND AGREES THAT PROMOTIONAL PARTIES SHALL NOT BE IN ANY WAY RESPONSIBLE FOR ANY RESULTING INJURY AND/OR DEATH.
